What is a Criminal Record Expungement?

Criminal Record Expungement is the process of removing a criminal record from your name on the National Criminal Database in terms of Section 271 B (1) of the Criminal Procedure Act, Act 51 of 1977. You can continue your life without a conviction to your name.

When Do I Qualify For a Criminal Record Expungement?

Applicants may apply for the expungement of a criminal record with the following conditions as set out in the Act:

• The conviction date is older than 10 years at the time of application;
• Sentenced to a fine of not exceeding R20 000-00;
• Sentenced to imprisonment with the option of a fine not exceeding R20 000-00;
• Corporal punishment;
• The sentence was postponed;
• You were cautioned and discharged;
• Imprisonment wholly suspended;
• Correctional supervision in terms of section 276(1)(h) of the Act;
• Periodical imprisonment in terms of section 276(1)(i) of the Act.

How Do I Apply For A Criminal Record Expungment?

To apply for your Criminal Record to be removed from your name, your original application forms and supporting documents must be submitted to the SAPS Criminal Record Centre, for your Police Clearance Certificate, and the Department of Justice and Constitutional Development for the Expungement process. Our team visits the SAPS CR&CSM and the DOJ&CD daily and will submit and follow up on your application, and collect the finalised certificate, all at one low fee. This service is available to applicants who are applying from abroad, as well as from within South Africa.

What Supporting Documents Do I Need?

In order for us to have your Criminal Record removed from your name, we require the following original documents from you:

• Expungement Application Form J744
• Signed Power of Attorney
• 2 x Original SAPS91a Fingerprint Enquiry Form
• 2 x SAPS Application Form
• 2 x SAPS Proof of Payment of R180, paid at the Police Station when having your fingerprints taken
  (We pay this on your behalf if you’re applying from abroad)
• 3 x Copy of your ID or Passport

When Do I Pay?

There are NO HIDDEN COSTS and NO UPFRONT PAYMENT! We will send you an invoice after we have submitted your application to the Criminal Record Centre. Thereafter you are afforded 7 days to make payment. However, we do not wait for your payment before starting the process. Upon receipt of your documents, we immediately compile and submit your application to the SAPS CR&CSM in Pretoria. This is to ensure that your application is in process with the SAPS CR&CSM in the shortest possible time.
