What is a criminal record expungement?
DPCC is a private facilitation service. We prepare, submit and follow up your application and collect the finalised outcome. We don't decide the outcome of applications.
Do I qualify?
In terms of the Criminal Procedure Act, you may qualify if:
- Your conviction is older than 10 years at the time of application, and
- You were sentenced to a fine not exceeding R20 000, or
- You were sentenced to imprisonment with the option of a fine not exceeding R20 000, or
- Corporal punishment was imposed, or
- Your sentence was postponed, or
- You were cautioned and discharged, or
- Imprisonment was wholly suspended, or
- Correctional supervision under section 276(1)(h) of the Act, or
- Periodical imprisonment under section 276(1)(i) of the Act.

We need these originals. Electronically transmitted applications are not accepted:
- Expungement application form J744
- Signed power of attorney
- 2 × original SAPS 91a fingerprint enquiry forms
- 2 × SAPS application forms
- 2 × SAPS proof of payment of R190, paid at the police station when fingerprints are taken (we pay it on your behalf if you apply from abroad)
- 3 × certified copies of your ID or passport

Cost and payment

Common questions
Can I apply from abroad?
Yes. We facilitate expungement applications from abroad and from within South Africa.
How old must the conviction be?
In terms of the Criminal Procedure Act, the conviction must be older than 10 years at the time of application. Other conditions relate to the type of sentence. See the list above.
Do I pay before you start?
No. You get an invoice after we submit, and we start as soon as we receive your documents.
Can I email scanned forms?
No. Original documents are required, except for ID/passport copies.
Do you decide whether my record is expunged?
No. DPCC submits and follows up. The outcome of the application is decided by the Department of Justice & Constitutional Development.
